Better Boat Privacy Policy

Love & Pieces LLC, doing business as Better Boat ("Better Boat," "we," "us"), runs the online store at betterboat.com (the "Site"). This Privacy Policy explains what personal information we collect when you visit the Site, buy from us, sign up for our emails or text messages, or contact customer support; how we use that information; who we share it with; and the choices you have.
If this Privacy Policy and our Terms of Service say different things about how we handle personal information, this Privacy Policy controls.
THE SHORT VERSION
* We collect information you give us (such as your name, email, phone number, shipping address and order details) and information collected automatically when you use the Site (such as the pages you view, what you type into the Site's search box, what you click and add to your cart, your device and browser, your IP address and your approximate location).
* We share that information with companies that run the Site for us, such as Shopify, and with analytics and advertising partners, such as Google, Meta, TikTok and Pinterest. Under some U.S. state laws, part of that sharing counts as "selling" or "sharing" personal information, or as "targeted advertising."
* If you visit from California, the European Union or the United Kingdom, analytics and advertising cookies stay off until you accept them in our cookie banner. If you visit from anywhere else, they run by default, and you can turn them off on our Your Privacy Choices page.
* You can ask to see, correct or delete your information by emailing support@betterboat.com or calling 800-571-6166.
INFORMATION WE COLLECT
Information you give us
* Contact details: your name, email address, phone number, and billing and shipping addresses.
* Order information: the products you buy, return or exchange, order totals, discount codes, and payment confirmation. Card payments are handled by Shopify and our payment processors (Shopify Payments, Shop Pay, PayPal and Amazon Pay). We do not see or store your full card number.
* Account information: if you create a customer account, your login details and saved preferences.
* Email and text sign-ups: your email address and, if you join our text messages, your mobile number and a record of your consent.
* Messages to us: what you write in emails, contact forms and other messages, and anything you attach, such as a photo of a product.
* Reviews and product registration: the rating, text, photos and name you post in a review, and the details you enter when you register a product for warranty support.
Information collected automatically
When you visit the Site, Shopify and the analytics and advertising tools listed in this policy collect information through cookies, pixels, tags, scripts and similar technologies (in this policy, "cookies"). This information can include:
* the pages you view, their web addresses (URLs), and the website or ad that sent you to the Site;
* the words you type into the Site's search box;
* your clicks, the products you view, items you add to your cart, the checkout steps you complete, and your purchases;
* your device type, operating system, browser, language and screen size;
* your IP address and the approximate location it points to (such as city, state or country);
* cookie IDs, advertising IDs and similar identifiers.
If you are signed in, have bought from us, or have given us your email address or phone number, this activity can be connected to your name, email address and order information. The Site may also share hashed (scrambled) contact information, such as your email address or phone number, with advertising partners, including Meta and Google, so they can measure how well our ads perform.
Session recording
We use PostHog to see how people use the Site so we can find pages that are broken or confusing. PostHog session recordings capture your clicks, scrolling and page navigation so we can replay a visit. Text you type into form fields is masked, so it is not captured in recordings.
Information from other sources
* Shopify, including through Shopify's Network Intelligence feature, described below.
* Payment processors, which tell us whether a payment went through and may flag suspected fraud.
* Advertising and social media platforms, for example when you click one of our ads or interact with Better Boat on Facebook, Instagram, TikTok, Pinterest or YouTube.
* Shipping carriers and fulfillment partners, which send us delivery status.
HOW WE USE PERSONAL INFORMATION
* To take, charge for and ship your orders, handle returns, refunds and warranty requests, and send order and shipping updates.
* To answer your questions and provide customer support.
* To run, fix and improve the Site, including learning which pages, searches and products people use.
* To send the emails and text messages you signed up for.
* To show you ads for Better Boat products on other websites and apps, including ads based on what you viewed, searched for or added to your cart on the Site, and to measure whether those ads work.
* To suggest products, such as "frequently bought together" items and offers shown in your cart or after checkout.
* To detect and prevent fraud and misuse, and to keep the Site secure.
* To comply with the law, enforce our Terms of Service, and handle legal claims.
WHO WE SHARE PERSONAL INFORMATION WITH
Service providers
We use companies that do work for us, such as hosting and checkout (Shopify), payment processing (Shopify Payments, Shop Pay, PayPal, Amazon Pay), shipping carriers and warehouses, email and text messaging (Klaviyo), product reviews (Opinew), website forms (HulkApps Form Builder), bot and spam protection on forms, website security and content delivery (Cloudflare), and our accountants, lawyers and other advisors. Printful is our print-on-demand fulfillment partner for made-to-order printed items; it receives the order and shipping details needed to produce and ship those items. Each provider receives the information it needs to do its work.
Analytics and advertising partners
The companies in the table below run tools on the Site. They can receive the information described under "Information collected automatically," including page URLs, site search queries, clicks, products viewed, add to cart, checkout and purchase events, device and browser details, IP address, approximate location, and cookie and advertising identifiers. For signed-in customers and purchasers, some of them also receive email address, name and order information.
Some of these partners combine this information with information they already hold and use it for their own purposes, such as improving their advertising systems, under their own privacy policies. Under the laws of California and several other states, this can count as "selling" or "sharing" personal information, or as "targeted advertising." You can opt out as described in "Your choices about cookies and tracking."
Shopify
What it does on the Site: Hosts the Site, runs checkout and Shop Pay, and provides store analytics. Also see "Shopify and Network Intelligence" below.
Google (Google Analytics 4, Google Ads and Google Merchant Center, through the Google & YouTube app)
What it does on the Site: Site analytics, ad measurement, and ads on Google, YouTube and partner sites.
Meta (Facebook and Instagram pixel and Conversions API, through the Facebook & Instagram app)
What it does on the Site: Ad measurement and ads on Facebook and Instagram. The Conversions API sends events from Shopify's servers to Meta directly, not only from your browser.
TikTok (TikTok pixel)
What it does on the Site: Ad measurement and ads on TikTok.
Pinterest (Pinterest tag)
What it does on the Site: Ad measurement and ads on Pinterest.
PostHog
What it does on the Site: Product analytics and session recording.
Klaviyo
What it does on the Site: Email and text message marketing and sign-up forms. Klaviyo also tracks site activity, such as products viewed and items added to cart, for people on our email or text lists so we can send messages such as cart reminders.
Zipify One Click Upsell
What it does on the Site: Offers shown in your cart and after checkout. Receives cart and order events.
CodeBlackBelt Frequently Bought Together
What it does on the Site: Product recommendations.
Opinew
What it does on the Site: Collects and displays product reviews.
Nile (AI commerce app, including its NoHi event pixel)
What it does on the Site: An AI shopping assistant and commerce provider that helps AI shopping tools, such as ChatGPT, find and describe Better Boat products, and measures sales that come from AI-driven visits. Receives site events, such as pages viewed, cart activity and purchases.
Trybe
What it does on the Site: Marketing attribution. Receives site events to measure which marketing led to visits and sales.
We do not sell or rent lists of our customers' names, email addresses or phone numbers to other companies. We do not share your mobile number or your text message consent with third parties for their own marketing.
Shopify and Network Intelligence
The Site runs on Shopify, which collects and processes personal information to host the Site and run checkout. We also use Shopify's Network Intelligence feature. With this feature on, Shopify combines information about your activity and purchases on our store with information from other Shopify stores and Shopify services, and uses it to build and improve Shopify's products, target ads, and personalize shopping experiences, as described in Shopify's Additional Services Terms. Other sharing
* With anyone you ask us to share with.
* To comply with the law or a valid legal request, such as a subpoena, and to protect our rights, our customers and the public.
* With companies under common ownership with Love & Pieces LLC.
* As part of a merger, sale of the business or its assets, financing, or bankruptcy, in which case the information may be transferred to the new owner.
YOUR CHOICES ABOUT COOKIES AND TRACKING
What happens on the Site depends on where you are visiting from. We estimate your location from your IP address, which is not always exact.
Visitors in California, the European Union and the United Kingdom
You will see a cookie banner with Accept, Decline and Manage preferences. Under Manage preferences you can turn on or off three categories: Analytics, Marketing and Personalization. All three are off by default. Until you accept, only the cookies the Site needs to work (such as your cart, checkout, security and remembering your cookie choice) run, and the analytics and advertising tools described above do not. To change your choice later, clear your browser's cookies for betterboat.com and the banner will appear again on your next visit.
Visitors everywhere else
Analytics and advertising cookies run by default. To turn off sharing for targeted advertising, go to Your Privacy Choices at https://betterboat.com/pages/data-sharing-opt-out. Your choice applies to the browser and device you use. If you clear your cookies, use a different browser or switch devices, you may need to opt out again.
Global Privacy Control
If your browser sends a Global Privacy Control signal, and you are in a place where the law requires us to honor it, we treat it as a request to opt out of the sale or sharing of your personal information and of targeted advertising for that browser and device. If we can connect the signal to a Shopify customer account, we apply the opt-out to that account too. Learn more at https://globalprivacycontrol.org/. We do not respond to other "Do Not Track" signals.
Other ways to limit tracking
* Your browser settings let you block or delete cookies. If you block all cookies, your cart and checkout may not work.
* You can manage ad settings in your Google, Facebook, Instagram, TikTok and Pinterest accounts, and use the industry opt-out pages at https://optout.aboutads.info and https://optout.networkadvertising.org.
* Google offers a browser add-on to opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout.
* To stop marketing emails, click "unsubscribe" in any of them. To stop text messages, reply STOP. We will still send messages about your orders.
KEEPING YOUR INFORMATION SECURE
Shopify encrypts checkout and payment information in transit, and payment card data is processed by Shopify and our payment processors under the Payment Card Industry Data Security Standard. We limit who at Better Boat can see customer information. No website or system is perfectly secure, so we cannot promise that information will never be accessed without permission. Please do not send card numbers or other sensitive information to us by email.
HOW LONG WE KEEP INFORMATION
We keep personal information only as long as we need it for the reasons in this policy. In general:
* Orders and transaction records: as long as needed for tax, accounting and legal requirements, typically up to 7 years.
* Customer account data: while your account is active.
* Email and text marketing data: until you unsubscribe or ask us to delete it. After that we keep a record of your opt-out so we can honor it.
* Analytics data and session recordings: according to each provider's settings, generally not more than 13 months.
We may keep information longer when the law requires it or when we need it to resolve a dispute or enforce our agreements.
CHILDREN
The Site is not meant for children. We do not knowingly collect personal information from children under 13. We do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.
YOUR PRIVACY RIGHTS IN U.S. STATES
Depending on where you live, including California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with similar laws, you may have the right to:
* Know and access: find out what personal information we hold about you and get a copy in a portable format.
* Delete: ask us to delete personal information we collected from you.
* Correct: ask us to fix information that is wrong.
* Opt out: tell us not to sell or share your personal information and not to use it for targeted advertising. We do not use personal information for profiling that produces legal or similarly significant effects.
* Non-discrimination: we will not deny you goods, charge you a different price, or give you worse service because you used these rights.
To make a request, email support@betterboat.com with "Privacy Request" in the subject line, or call 800-571-6166. To opt out of selling, sharing and targeted advertising, you can also use https://betterboat.com/pages/data-sharing-opt-out or send a Global Privacy Control signal.
We will verify requests to know, delete or correct by matching information you give us, such as your email address and an order number, to our records. You can use an authorized agent. We will ask the agent for proof that you gave permission, and we may ask you to confirm your identity with us directly. We respond within 45 days. If we need more time, we will tell you and may take up to 45 more days as the law allows.
Appeals: if we deny your request, you can appeal by replying to our decision with "Appeal" in the subject line within 60 days. We will respond within the time your state's law requires. If you disagree with our answer to your appeal, you can contact your state attorney general.
NOTICE TO CALIFORNIA RESIDENTS
This section adds to the rest of this policy and applies to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

We do not have actual knowledge that we sell or share the personal information of consumers under 16.

Your rights and how to use them: see "Your privacy rights in U.S. states." California residents who visit the Site see our cookie banner, and analytics and advertising cookies stay off unless they accept.
Notice of financial incentive
We currently offer 10% off your first order when you sign up for our emails or text messages through the sign-up form on the Site. We may change or end this offer, and from time to time we may offer other discounts, rewards or promotions to people who sign up or take part in other programs. The terms of each offer will be shown where you sign up.
* What we collect: your email address or mobile number, and the information described in this policy about your use of the Site and your purchases.
* How to opt in: enter your email address or mobile number in the sign-up form and accept the offer terms shown there.
* How to withdraw: you can leave at any time by clicking "unsubscribe" in any email, replying STOP to any text, or emailing support@betterboat.com. Rewards or discounts you already received are not affected, unless the offer terms say otherwise.
* Value of your information: we make a good-faith estimate that the value of your information to us is about equal to the value of the discount or reward we offer, based on what it typically costs us to reach and keep a customer through marketing.
Signing up is optional. We will not treat you differently if you choose not to join.
Shine the Light
California Civil Code Section 1798.83 lets California residents ask, once a year, for information about the personal information we disclosed to third parties for their own direct marketing purposes in the prior calendar year. To ask, email support@betterboat.com with "Shine the Light" in the subject line.
Removing content posted by minors
If you are a California resident under 18 and posted a review or other content on the Site, you can ask us to remove it by emailing support@betterboat.com. Removal may not erase every copy, such as copies others have shared.
NOTICE TO VISITORS IN CANADA
If you are in Canada, we handle your personal information under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including Quebec's Act respecting the protection of personal information in the private sector as amended by Law 25.
* Consent: we collect, use and share personal information as described in this policy with your consent, which you can withdraw at any time, subject to legal and contract limits. Withdrawing consent may mean we cannot fill an order.
* Your rights: you can ask to access and correct your personal information, and, where Quebec law applies, to ask about automated processing and data portability.
* Storage outside Canada: your information is stored and processed in the United States and other countries where our service providers operate, and may be accessible to courts and authorities in those countries.
* Complaints: contact our privacy officer first. You can also complain to the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d'accès à l'information.

NOTICE TO VISITORS IN THE EUROPEAN UNION AND UNITED KINGDOM
We ship only within the United States, but if you visit the Site from the EU or UK, these laws may apply to you. We rely on these legal bases: performing our contract with you (orders and support), our legitimate interests (running and securing the Site and preventing fraud), your consent (analytics and advertising cookies, and marketing), and legal obligations (tax and accounting records). You have the right to access, correct, delete, restrict or object to our use of your personal information, to data portability, and to withdraw consent at any time. You can also complain to your local data protection authority.
INTERNATIONAL TRANSFERS
Better Boat is based in the United States. Your information is stored and processed in the United States, and some service providers may process it in other countries. When we transfer personal information from the EU or UK, we rely on recognized transfer mechanisms, such as the European Commission's Standard Contractual Clauses or the UK equivalent, unless the destination has been found to provide adequate protection.
CHANGES TO THIS PRIVACY POLICY
We may update this policy when our practices, tools or the law change. We will post the new version on this page and change the "Last updated" date. If we make a material change, we will give notice as the law requires, for example by email or a notice on the Site.
